Instruction on Application of Residence Certificate for Personal Matters by Visiting or Accompanied Relatives of Foreigners Working or Studying in Wujiang District-Visas-Wujiang

【Legal basis】Exit and Entry Administration Law of the People’s Republic of China, Regulations of the People’s Republic of China on Administration of the Entry and Exit of Foreigners

1. The applicant’s original valid passport

2. A completed Visa/Stay Permit/Residence Permit Application Form

3. Two recently-taken, two-inch, half-length, bareheaded and full-faced color photos (by the standard of the Guidelines For Travel Documents Photographs)

4. An application letter (or submit the explanation letter of kinship and the work/study acceptance letter of the foreigner to be visited, containing the information of the applicant, the information on the relative to be visited working and studying in Wujiang District and the work/study unit, the kinship between the applicant and the foreigner to be visited, the purpose and items of application, residence duration specified in the visa, and the signature of the foreigner to be visited with date and the seal of the unit) 

5. The latest valid Accommodation Registration Form

6. A valid health certificate (issued by Administration for Entry-Exit Inspection and Quarantine. Those under the age of 18 and who apply for extension of the residence permit are exempt from the certificate), either the original one or a copy with the original checked

7. Copies of the data page, the valid visa or residence permit page, and the page stamped for the latest entry of the applicant’s passport (The originals shall be checked.)

8. Copies of the passport data page, the valid residence permit page or visa page, and the page stamped for the latest entry of the foreign relative to be visited working and studying in Wujiang District (The originals shall be checked.)

9. A copy (the original checked) or the original of the proof of kinship between the applicant and the foreigner to be visited

10. Where the applicant apply for the residence permit along with the foreigner working or studying in Wujiang District, the Foreigner Work Permit and the affirmative written decision of administrative license (or the valid Foreigner Employment Permit, or the Foreign Expert Work Permit) of the foreigner working in Wujiang District or a copy (the original checked) of the admission certificate of the foreigner studying in Wujiang District

11. Copies of valid business licence or relevant registration certificates of the work unit of the foreigner to be visited (those without a unified social credit code shall provide the organization code certificate), (incorporation in special industries) the approval certificate or recordation certificate (depending on the nature of the entity) (The copies shall be submitted, and the originals be checked.)

12. Other documents asked by the exit and entry administration authority of the public security organ (e.g. relevant guarantee certificates)

1. Holders of S1 visa shall apply for a residence permit within 30 days after the entry, otherwise the residence shall be illegal.

2. For the first application, the applicant shall do it in person, and for reapplications, appointed persons of the work unit or a relative can do it on his/her behalf.

3. The validity period of applicant’s visa must be long enough to apply for the work-type residence permit, and there must be over two blank visa pages.

4. According to the Nationality Law of China, those who have lost Chinese nationality yet the Chinese household registration has not been canceled are required to cancel the registration first. An application made by a person identified as Chinese under the Nationality Law of China shall not be accepted (unless the Chinese nationality is renounced).

5. Proof of kinship (proof of marriage, proof of birth, proof of kinship, and proof of name or other personal information change): provided by the relevant competent authority or notary department, or provided by the embassy or consulate of the applicant’s own country in China. The proof of kinship provided by the relevant foreign competent authority or notary department of holders with other types of visa shall be authenticated by the embassy or consulate of the Republic of China in the country of the applicant or the embassy or consulate of that country in China. The certification documents in a foreign language shall be translated into Chinese by legally registered translation agencies and then submitted.

6. The application for extension of a residence certificate shall be made 30 days before the expiry of the validity period of the residence certificate. Where registration items of the residence certificate have changed (such as reissuance of passport), reissuance of the residence certificate shall be applied for within 10 days from the date of change.

7. The applicant can apply for a residence permit with the same validity period (no less than 180 days) as the foreigner to be visited, not exceeding that of the passport. Besides, the validity period of the residence permit (or the residence permit to be applied) of the foreigner to be visited shall be no less than 6 months upon the application.

8. Where the applicant’s passport is retained for application processing, the applicant may reside in China legally for 15 days on the strength of the receipt of acceptance (printed with a color license photo or attached with a license photo seal by the issuing agency). Foreigners have the right to enter and exit China within the validity period of the residence permit.

9. Please be cautious of the following circumstances, the consequence of which should be answered for by the applicant and the employing entity:

(1) Rejection of the application of the residence permit where the applicant fails to provide qualified passport, photo or corresponding application materials;
